Forced Marriages

A forced marriage is one which is entered into without the full and free consent of either or both parties. Legislation was introduced in November 2008 to help people who are being forced into marriage or have already been forced into marriage. This includes the power to make a protection order to prevent such a marriage taking place; or voiding a marriage which has already taken place.

An application can be made by either party or by someone else on behalf of one of the parties, if they are concerned about the marriage being a forced marriage, however the third party would need the leave of the Court.

This is a matter where urgent instructions should be given at an early stage.
